Eligible debtors can get rid of credit card debt, personal loans, medical bills, apartment lease debt and repossession deficiencies. The U.S. Trustee’s office oversees the bankruptcy process and publishes median income and means test information per state which is critical to determining whether you are eligible to file a chapter 7. The median income is set for each household size and generally speaking if you make less than the median income for your household you can file a chapter 7. If you make more you can still qualify if you pass the means test.

 

Chapter 13 Bankruptcy

If you have an income and are struggling to pay your debts, you may consider filing chapter 13 bankruptcy. A chapter 13 bankruptcy comprises of a payment plan lasting between 3 and 5 years.
