Bankruptcy

For a brief overview of the bankruptcy process view this video. Please note that I am not affiliated with the legal aid society of Kentucky  and the video is presented for informational purpose only.

Chapter 7 Bankruptcy

A chapter 7 bankruptcy allows debtors to discharge debts and walk away without making a single payment to creditors. Hence, it is also known as the liquidation bankruptcy. Eligible debtors can get rid of credit card debt, personal loans, medical bills, apartment lease debt and repossession deficiencies. The U.S. Trustee’s office oversees the bankruptcy process and publishes median income and means test information per state which is critical to determining whether you are eligible to file a chapter 7. The median income is set for each household size and generally speaking if you make less than the median income for your household you can file a chapter 7. If you make more you can still qualify if you pass the means test.

Chapter 13 Bankruptcy

If you have an income and are struggling to pay your debts, you may consider filing chapter 13 bankruptcy. A chapter 13 bankruptcy comprises of a payment plan lasting between 3 and 5 years. I routinely help homeowners stop foreclosure by filing a chapter 13 plan that pays off the arrears over time. .The median income and means test play an even bigger role in chapter 13 bankruptcy because it helps determine what your disposable monthly income is. The disposable monthly income determines how much your monthly plan payment has to be and often must be paid in entirety to the trustee.

If your income is below the household median income your plan does not have to exceed 3 years. But if you if you make more than the median income then you have to complete a 5 year plan unless you pay all of your debt. As a Bethesda bankruptcy lawyer, I am here to show you how a chapter 13 bankruptcy can save your home from foreclosure and pay the mortgage arrears over time or help you get out of debt.
