DePuy ASR™ XL Acetabular System

DePuy Orthopaedics, Inc. issued a recall of the DePuy ASR TM total hip system because of higher than expected revision rates within 5 years, which  were approximately 13 percent, based on data from the United Kingdom.

$2.5 Billion Settlement

On November 19, 2013, a settlement agreement was entered between DePuy Orthopaedics, Inc. and the plaintiffs for patients in the United States who had surgery to replace their ASR™ XL Acetabular Hip System or ASR™ Hip Resurfacing System, known as revision surgery, before August 31, 2013. 

Revision Surgery After Bar Date or No Revision Surgery Rights

Those who did not have their DePuy ASR hip replaced prior to August 2013 may still have a claim for their injuries, financial losses as well as pain and suffering. 

The estimated payout amounts to $350,000.00 per patient who received revision surgery. Some patients have called the settlement unfair as exhibited by a report by  NBC Chicago: The station followed a patient for several years as she had revision surgery and entered litigation.

 

Deadline to Register

Class members have to register by September 30, 2014.
