A chapter 7 bankruptcy allows debtors to walk way without making payment for debts such as credit cards, personal loans, medical bills, apartment leases and repossessions. You have to qualify based on the median income as published by the U.S. Trustee’s office.The government sets the median income per each household size and uses this figure to determine eligibility. If you make less than the median income for your household size then you can file a chapter 7 and receive a discharge assuming that there are no other issues with your case.

Chapter 13 Bankruptcy

If you have an income then you may be eligible to file a chapter 13 to help you pay off debts. Often, chapter 13 is used to save homes from foreclosure and cars from repossession. A CHAPTER 13 BANKRUPTCY in Maryland involves a debt repayment plan that can last between 3 or 5 years. Going back to the median income issue discussed above, if you are below your household’s median income then you can propose a plan that lasts up to 3 years. If you make more than the median income for your household then you have to propose a 5 year plan unless you are paying 100% of your debt.
